Drive Express

Welcome to Drive Express. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Drive Express (“Drive Express”, “we”, “our”, or “us”), a company providing a digital platform that connects users seeking transportation services with independent third-party transportation providers.

By accessing or using our mobile application, website, and related services (collectively, the “Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Our Services

Drive Express is a technology-based taxi aggregator platform. We provide the tools for users to:

  • Request transportation services through the app;

  • Connect with independent Drivers;

  • View trip details, driver information, and estimated fares;

  • Make secure payments through the app.

Note: Drive Express does not own vehicles or employ Drivers. All Drivers are independent contractors.

2. Definitions

  • Platform: Includes the Drive Express mobile application, website, APIs, and backend services.

  • User: Any individual who downloads, installs, or uses the Platform, including Passengers and Drivers.

  • Passenger: A user who books transportation through the Platform.

  • Driver: A third-party independent transportation provider who offers ride services via the Platform.

  • Ride: A trip requested by a Passenger and fulfilled by a Driver.

  • Service Fee: A fee charged by Drive Express to Drivers for use of the Platform.

3. User Eligibility and Account

3.1 Eligibility

To use the Platform, you must:

  • Be at least 18 years of age;

  • Have the legal authority to enter into binding contracts;

  • Possess a valid mobile number and email address;

  • Comply with all applicable laws.

3.2 Account Registration

Users must create an account by providing:

  • Name, contact number, and email;

  • Government-issued ID (for Drivers);

  • Valid vehicle registration and insurance (for Drivers).

You are responsible for maintaining the confidentiality of your login credentials and are liable for all activities conducted under your account.

4. Passenger Guidelines

Passengers agree to:

  • Provide accurate pick-up and drop-off details;

  • Treat Drivers with respect and courtesy;

  • Not use the service for illegal or unsafe activities;

  • Pay the full fare as shown in the app at the end of the ride;

  • Avoid cancellation abuse.

Failure to comply may result in account suspension or termination.

5. Driver Guidelines

Drivers must:

  • Possess a valid driving license, insurance, and vehicle registration;

  • Maintain their vehicle in roadworthy condition;

  • Follow all traffic rules and local regulations;

  • Act professionally and respectfully toward passengers;

  • Only accept rides via the Drive Express app;

  • Not transfer their account or delegate rides to others.

Drive Express reserves the right to perform background checks and suspend or deactivate accounts that violate safety or performance standards.

6. Pricing, Payments, and Fees

6.1 Fares

Fares are calculated based on:

  • Distance, time, and traffic conditions;

  • Surge pricing during high-demand periods;

  • Applicable taxes and regulatory charges.

The estimated fare is shown in advance, but the final fare may vary based on route changes or waiting times.

6.2 Payment Processing

Drive Express uses third-party payment gateways. Passengers agree to:

  • Provide valid payment details;

  • Authorize Drive Express to charge the fare after ride completion.

Cash payments may be allowed, depending on local regulations.

6.3 Cancellation and No-show Fees

If a ride is canceled after a Driver has been assigned or a Passenger fails to show up, a cancellation fee may be charged to compensate the Driver for their time and effort.

7. Service Fees and Earnings

Drive Express charges Drivers a platform service fee (a percentage of the total fare) for every completed ride. This fee helps cover app maintenance, customer support, and driver support services.

Earnings after service fee deduction will be transferred to the Driver’s registered bank account as per the payment schedule.

8. Promotions and Referral Programs

Drive Express may offer:

  • Promotional codes to new or existing users;

  • Referral bonuses for inviting new users or Drivers.

All promotions are governed by specific terms, may be revoked at any time, and cannot be redeemed for cash or combined unless otherwise stated.

9. User Conduct and Restrictions

You agree not to:

  • Use the Platform for any unlawful or unauthorized purpose;

  • Transmit any harmful or disruptive code;

  • Attempt to access another user’s account;

  • Abuse or harass Drivers, Passengers, or Drive Express personnel;

  • Impersonate another person or provide false information;

  • Collect or store data about other users without consent.

Drive Express has a zero-tolerance policy for abuse, fraud, and misconduct. Violators will face immediate account suspension or permanent ban.

10. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, software, and design elements, is the exclusive property of Drive Express or its licensors and is protected under copyright, trademark, and intellectual property laws.

Users may not copy, reproduce, distribute, or create derivative works without prior written permission.

11. Disclaimers

  • Drive Express does not guarantee the availability or reliability of rides;

  • We are not responsible for the behavior, performance, or misconduct of any Driver or Passenger;

  • The Platform is provided “as is” and “as available” with no warranties of any kind, express or implied.

12. Limitation of Liability

To the fullest extent permitted by law, Drive Express shall not be liable for:

  • Any indirect, incidental, special, or consequential damages;

  • Accidents, personal injuries, or property damage occurring during a ride;

  • Delays or failures in performance due to circumstances beyond our control.

Total liability under any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Drive Express, its affiliates, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of:

  • Your use of the Platform;

  • Your breach of these Terms;

  • Any violation of laws or rights of a third party.

14. Account Termination

Drive Express reserves the right to:

  • Suspend or delete your account without notice for any violation of these Terms;

  • Pursue legal remedies for misconduct, fraud, or harm caused to the company or its users.

You may also terminate your account at any time by contacting customer support.

15. Data and Privacy

Your personal data is processed in accordance with our Privacy Policy, which outlines:

  • What information we collect;

  • How we use and store it;

  • Your rights regarding your data.

We follow industry-standard practices to secure your data but cannot guarantee absolute security.

16. Modifications to the Terms

Drive Express may modify these Terms at any time. We will notify you through the Platform or via email. Continued use of the services after updates constitutes your agreement to the revised Terms.

17. Governing Law and Dispute Resolution
